Terms and Conditions
Welcome to Dertz Infotech LLP. These Terms and Conditions govern the services provided by Dertz Infotech LLP ("we", "us", "our") to our client ("you", "the Client").
1. Agreement
By engaging Dertz Infotech LLP for any project or service, or by transferring payment for any service, the "Client" agrees to the terms and conditions outlined herein for the work engagement. The specific scope of work, deliverables, timelines, and fees will be detailed in a separate Project Proposal or Statement of Work (SOW), which forms part of this agreement.
2. Payment Terms
There are various ways in which we collect personal information of our clients and those interested in knowing about our offerings. This could be through emails to our employees, queries for stay, interaction on our Facebook pages and / or recommendation by your friends and acquaintances. This information could include your name, home and office addresses, date of birth or dates of other important occasions, your credit card information, your bank account details or any other information that is required / received during the interaction. We make best efforts not to collect personal information of anyone under the age of 18 years. We also do not knowingly collect information on ethnic origin, political views, religious beliefs or sexual orientation.
- Payments for all services are due as per the schedule outlined in the individual project proposals or invoices.
- The Client is responsible for any third-party costs incurred as part of the project, such as software licenses, cloud services (e.g., AWS, Azure), domain registration, or other subscription fees. These costs are separate from our service fees and will be billed accordingly, often directly to the Client.
- We reserve the right to pause services if payments are not made by the due date. Late payments may be subject to interest charges at a rate of 1.5% per month on the outstanding amount.
3. Client Responsibilities
To ensure the timely and successful completion of the project, the Client agrees to provide all necessary access, materials, and information. This includes, but is not limited to:
- Access to servers, hosting panels, website backends, and existing codebases.
- For BIM services: architectural plans, structural data, and relevant project files.
- Brand assets such as logos, fonts, and brand guidelines.
- Timely feedback and approvals at each stage of the project.
Any delays from the Client in providing these necessary items may result in a corresponding delay in the project timeline and may incur additional costs.
4. Confidentiality
Both Dertz Infotech LLP and the Client agree to treat all information shared during the engagement as confidential. This includes business processes, technical data, and project details. This obligation of confidentiality will extend beyond the termination of our engagement.
5. Intellectual Property (IP)
- Upon receipt of full and final payment for a project, all rights to the final deliverables and custom code/models created specifically for the Client will become the property of the Client.
- We retain the ownership of any pre-existing code, libraries, plugins, processes, or technology used to complete the project. The Client will receive a license to use these items as part of the final deliverable.
- We retain the right to use the work and a description of the project for our portfolio, case studies, and other marketing purposes, while respecting the confidentiality of the Client's proprietary information.
6. Term & Termination
- The term of this agreement will be specified in the project proposal, which may be on a per-project basis or a monthly retainer.
- Should the Client wish to terminate an ongoing service agreement, a 30-day written notice is required.
- Upon termination, the Client is required to pay for all services rendered and work completed up to the effective date of termination. Fees for services already performed are non-refundable.
- We may terminate the agreement with immediate effect if the Client fails to make timely payments or breaches any material term of this agreement.

This agreement, and any dispute arising from it, shall be governed by the laws of the jurisdiction of Lucknow, Uttar Pradesh, India.

Refund Policy
Dertz Infotech LLP is committed to client satisfaction. Our refund policy is as follows:
1. General Principle
Our services involve significant time and resources. Therefore, payments made to us for services already rendered are non-refundable. This applies to completed project milestones, hours worked, and any third-party costs that have been incurred on the Client's behalf.
2. Project Cancellation
If a project is cancelled by the Client before completion, the Client is liable for payment for all work completed up to the date of cancellation. Any advance payments for upcoming milestones or work not yet started may be refunded, less any administrative or unrecoverable costs.
3. Non-Performance
We strive to deliver the services outlined in each project proposal. If the Client believes we have failed to deliver on our commitments, they must provide a written notice detailing the specific areas of non-performance. We will have a 30-day "cure period" to address and rectify the issues. If the specified issues are not resolved within this period, a partial or full refund for the specific, undelivered component of the service may be considered on a case-by-case basis.
4. Exclusions
Refunds will not be provided for:
- Delays caused by the Client's failure to provide necessary access, content, or feedback.
- Third-party service costs (e.g., software licenses, cloud hosting) that are non-refundable to us.
- Dissatisfaction with subjective or creative aspects of the work, provided the work aligns with the project proposal and any feedback provided by the client during the development process.
5. Refund Processing
Once a refund is approved by Dertz Infotech LLP, it will be processed within 7 working days to the original method of payment, unless otherwise agreed upon in writing.
